General Terms and Conditions of Sale – Renewfit / Gymworks

1. General provisions

Unless expressly agreed otherwise in advance, all our sales are subject to these general terms and conditions of sale. The buyer is deemed to have read and accepted all clauses herein. These conditions must be signed by the buyer.

The buyer is informed of the characteristics of our products on www.renewfit.com. Minor variations between delivered products and the photographs displayed on the website do not affect the validity of the buyer’s consent.

2. Prices and payment

Prices are expressed in euros, excluding taxes, ex-warehouse in France, and are valid on the date the quotation is issued. Prices may be revised in accordance with applicable legislation. Prices may be updated if the order exceeds the quotation validity period or if the goods are not collected within 30 days of the scheduled delivery date.

Payment terms are as follows: 50% deposit upon order by cheque or bank transfer, with the balance payable upon delivery. In the event of non-payment, GYMWORKS may suspend delivery or refuse any new order. Late payment interest amounts to 1.50% per month, plus a fixed penalty of 20% of the amounts due.

For any order delivered outside mainland France, full payment of the balance is required at the time of shipment, i.e. when the goods are ready to leave our warehouses, unless an exceptional agreement is expressly stated by GYMWORKS at the time of order.

3. Orders

Orders are based on a quotation issued by GYMWORKS, valid for 30 days. The buyer must return the signed quotation marked “approved”, together with a 50% deposit and the signed general terms and conditions of sale. After this period, GYMWORKS reserves the right to refuse the order and issue a new quotation.

4. Delivery, transport and installation

Transport is not included in the price and is carried out at the recipient’s risk. Unless delivery includes installation, delivery is made at ground level in locations accessible to vehicles. Delivery times are indicative and do not entitle the buyer to cancellation or claims in the event of delay.

For deliveries including installation, the date and time are agreed jointly with the technicians. The buyer must check the parcels and their condition upon delivery and report any damage or missing items on the delivery note.

Any products not reported by registered letter within three days shall be deemed accepted. In the event of return due to non-receipt, costs shall be borne by the buyer. Deliveries outside mainland France are subject to a specific quotation.

For any order delivered outside the European Union, any return of goods—partial or total, for any reason whatsoever—shall be entirely at the buyer’s expense, including transport, insurance and all customs import and export charges.

5. Contractual warranty

Our products are covered by a two-year warranty against manufacturing defects, and twelve months for refurbished products. The warranty covers only the repair or replacement of defective parts, excluding consumables (cables, cushions, running belts, etc.). Labour and travel are included within mainland France. For products outside mainland France, these costs are borne by the buyer.

The warranty does not cover damage resulting from improper use, modification or incorrect installation.

6. Legal warranty

The products are also covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with the French Consumer Code and Civil Code (articles L.211-4, L.211-5, L.211-12, 1641 and 1648).

7. Right of withdrawal

The buyer has fourteen (14) clear days following delivery to exercise the right of withdrawal, without justification or penalty. The request must be made by registered letter or email.

The product must be returned to the address designated by GYMWORKS, in its original packaging and with all accessories. Return costs are borne by the buyer, except in the case of delivery of a replacement product.

8. Liability

GYMWORKS declines all liability for damage caused by use not in accordance with the instructions in the manuals or notices. The user must verify product compatibility and comply with safety rules.

9. User manuals

User manuals and instructions are provided upon request at info@renewfit.com.

10. Retention of title

Ownership of the products is transferred only after full payment has been made. The buyer may not pledge the products or use them as security. In the event of loss or damage, GYMWORKS remains the beneficiary of insurance compensation.

11. Personal data

Personal data collected when orders are placed is processed for order management and, unless objected to, for the sending of information or offers. In accordance with applicable data protection laws, the buyer may exercise rights of access, rectification and deletion.

12. Applicable law

These general terms and conditions of sale are governed by French law. Any dispute shall be submitted to the competent courts of the defendant’s domicile, unless another jurisdiction is chosen.
