Terms and Conditions of Sale - Renewfit / Gymworks
1. General Terms
Unless otherwise agreed in writing, all our sales are governed by these general terms and conditions. The buyer is deemed to have read and accepted all clauses. These terms must be signed by the buyer.
The buyer is informed of the product specifications on www.renewfit.com. Minor differences between delivered products and website images do not invalidate the buyer’s consent.
2. Price and Payment
Our prices are in Euros, excluding VAT, ex-warehouse in France, and valid on the quotation date. They may be revised under applicable laws. Prices may change if the order exceeds the quotation validity period or if the goods are not picked up within 30 days of the scheduled delivery date.
Payment terms: 50% at order by check or bank transfer, balance on delivery. In case of non-payment, GYMWORKS may suspend delivery or refuse new orders. Late payment incurs 1.50% interest per month and a flat penalty of 20% of the due amount.
3. Order
Orders are based on a GYMWORKS quotation valid for 30 days. The buyer returns the signed quotation with “approved” and a 50% deposit, along with signed terms and conditions. Beyond 30 days, GYMWORKS may refuse the order and issue a new quotation.
4. Delivery, Transport, and Installation
Transport is not included and is at the buyer’s risk. Unless including installation, delivery is made at ground level to accessible locations. Delivery times are indicative only and do not allow cancellation or compensation.
For deliveries with installation, date and time are agreed with technicians. Buyer must check packages upon delivery and report any damage or missing items on the delivery slip.
Any product not claimed within 3 days via registered mail is deemed accepted. Return fees due to failed delivery are borne by the buyer. Deliveries outside mainland France require a specific quote.
5. Warranty
Our products are covered by a 2-year warranty against manufacturing defects and 12 months for refurbished items. Warranty covers repair or replacement of defective parts, excluding consumables. It includes labor and travel in mainland France. Outside France, these costs are the buyer’s responsibility.
Warranty excludes damage due to misuse, modification, or incorrect installation.
6. Legal Warranty
Products are also covered by the legal warranty of conformity and hidden defects under French law (Articles L.211-4, L.211-5, L.211-12, 1641, and 1648).
7. Withdrawal
The buyer has 14 full days after delivery to exercise the right of withdrawal without justification or penalty. Requests must be made by registered letter or email to:

Returned products must be sent in original packaging with all accessories. Return costs are the buyer’s responsibility unless a substitute product was delivered.
8. Liability
GYMWORKS is not liable for damages caused by improper use not in accordance with the manuals. The user must ensure product compatibility and follow safety instructions.

10. Retention of Title
Ownership transfers only after full payment. The buyer may not pledge or use products as collateral. In case of damage or loss, GYMWORKS retains rights to any insurance compensation.
11. Personal Data
Personal data collected during orders is used for order management and, unless opposed, to send information or offers. Under data protection laws, buyers may exercise rights at:

12. Governing Law
These terms are governed by French law. Disputes shall be submitted to the competent courts of the defendant's domicile, unless another jurisdiction is chosen.
